PowderLogic is a ski resort recommendation platform that analyzes real-time data including weather conditions, traffic patterns, canyon road status, lift operations, and other factors to provide recommendations for Utah ski resorts.

The Service may include:

• Canyon road status updates
• Email alerts for conditions you subscribe to

All recommendations are for informational purposes only and do not guarantee any particular conditions or outcomes.

You may use the Service only if:

• The PowderLogic scoring algorithm and methodology

Except for the limited right to access and use the Service, no other rights are granted.

PowderLogic expressly disclaims all warranties including:

• AVAILABILITY OR UPTIME

PowderLogic does not warrant that our recommendations will result in safe, enjoyable, or optimal skiing conditions. You assume all risk for your use of the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• POWDERLOGIC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR BUSINESS INTERRUPTION
• POWDERLOGIC'S TOTAL AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100)

These limitations apply regardless of the cause of action, whether in contract, tort (including negligence), or otherwise.

You agree to indemnify, defend, and hold harmless PowderLogic and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any law or third-party right
• Any injury, accident, or loss related to your skiing or travel activities

10. Modifications

PowderLogic may modify the Service or these Terms at any time. We will post updated Terms on the website and update the "Effective Date." Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Delaware, and you consent to the personal jurisdiction of these courts.
